  • Cinsel suç mağdurları, mahkemeler ya da savcılıklar tarafından “suça ilişkin kanıt elde etmek amacıyla” muayene edilmeleri için hekimlere gönderilebilirler. Bu olgularla karşılaşan hekimler, muayene öncesinde, mağdurları yapılacak muayenenin amacı, muayenenin nasıl yapılacağı ve muayene sonucunda elde edilecek bulguların sağlayacağı hukuki yarar konusunda aydınlatmalıdır. Muayene mağdurun aydınlatılmış onamı alındıktan sonra yapılmalıdır. Hekimler, diğer hastalarda olduğu gibi, bu olguların muayenelerinde de mesleki etik kurallarına uymakla yükümlüdür. Hekim, bir insan olarak hastasının haklarına sahip çıktığında hukuki soruşturmalarla yüz yüze gelebilir. Ancak, hekimlik değerleri ile insan hakları hukukunun örtüştüğü iyi hekimlik uygulamaları hiçbir biçimde suç oluşturmaz. Bu yazıda, hekimlerin yargılanıp beraat ettiği iki olgu üzerinden, cinsel suç mağdurlarının muayeneleri sırasında hekimlerin mesleki tutumlarının nasıl olması gerektiği tartışılmıştır.

Summary

  • The victims of sexual assault may be sent to physicians by the courts or prosecutors to be examined for evidence of the crime. The physicians who are dealing with these cases should inform the victims before the examination, regarding the purpose of the examination, how the examination will be carried out and the findings to be obtained by the examination. The examination should only be performed after the victim’s informed written consent. As in other patients, physicians are obliged to comply with the rules of medical ethics for examinations of sexual assault victims. A physician may have to encounter judicial inquiries when he/she claims the rights of the case not just as a patient, but also as a human being. However, good medical practices where medical values are combined with human rights law cannot constitute a crime. In this paper, ideals and how medical practices of physicians should be in the course of the medical examination of sexual assault victims were reviewed over two cases, where physicians were sent for trial and were acquitted.
