Bu çalışmada “hak”, “hakkaniyet” ve “eşitlik” kavramları tarihsel süreçte içerik olarak incelenmiştir. Sınıfl ı toplumlarla birlikte insanlığa mal olan bu kavramların, sınıfsız toplumsal yaşantının ardından yaşanan ekonomik, toplumsal ve siyasal farklılıklardan köken aldığını söyleyebiliriz. Çalışmada hakkaniyetin, bölüşümün adaletli olmasının sağlanmasıyla sınırlı olduğu bu nedenle, eşitliğin yerine kullanılmasının doğru olmadığı belirlenmiştir. Makalenin sonunda, eşitlik, “hayatın öznesinin insan olduğu bir toplumsal yaşantı ile her bir bireyin gereksinimlerinin karşılanması hedefidir” olarak tanımlanmıştır. Böylece eşitlik isteminineşitliğin, statik değil, dinamik bir içeriğe sahip olduğu belirlemesi ortaya konmuştur.

This study examines the concepts of “right”, “equity” and “equality” with reference to their content in historical process. It can be said that these concepts derived from economic, social and political diff erences and became inherent in class societies that historically followed classless society. The study asserts that the concept of equity is limited to ensuring a relatively fair distribution and therefore,it is not correct to use the concept as the same with equality. At the end of the article equality is defined as the “objective of responding to the needs of each and every individual in a social life where humankind is the subject of life.” This approach stresses the dynamic nature of the call for equality against a static outlook.followed classless society.
