Korkuya karşı hukukun hâkim olmadığı bir düzende korku hâkim duygudur. Bu açıdan bakıldığında, Roosevelt’in meşhur 4 özgürlük konuşmasında kullandığı “korkudan özgür” olmak (freedom from fear) kavramının devletler yanında bireyler için de kullanılabileceği açıktır. İnsan Hakları Evrensel Bildirgesi’nin korkudan özgürlüğü, ifade ve inanç özgürlüğü ile birlikte en yüksek amaç olarak saymasını bu açıdan yadırgamamak gerekir. Korkudan özgür olmak kavramının en az üç anlamı olduğunu söyleyebiliriz. Birincisi modern hukukun özünün, kişiyi korkuya karşı korumak olduğu gerçeği. İkincisi, korkudan özgürlüğün başka hakların kurucu bir unsuru olması. Üçüncüsü ise korkudan özgürlüğün bağımsız bir hak olması. O halde, korkudan özgürlüğün güvence altına alınmadığı bir düzenin çağdaş anlamda bir hukuk düzeni olmadığını ve tek başına anayasadan yoksunluk anlamına geldiğini de saptamak mümkün olacaktır.

The fear is the dominant feeling in a regime that lacks rule of law against fear. From this perspective, it is clear that the “freedom from fear” concept, which Roosevelt has articulated in his famous speech “The Four Freedoms”, can be used for the individuals as well as for the states. In this respect, it should not be found odd that the Universal Declaration of Human Rights regarded freedom of fear as the fundamental goal along with the freedoms of expression and belief. The concept of “freedom from fear” has at least three meanings. The first one implies the fact that the principle of modern law is protecting the individual against fear. Secondly, freedom from fear is the constituent element of the other rights. Thirdly, freedom of fear is an independent right. Then, it is also possible to state that a regime, which doesn’t protect the freedom of fear, is far from being a state under the rule of law in contemporary sense and it alone denotes the lack of constitution.
