Özet

  • Güvenlik soruşturması uygulamaları ile kişilerin siyasal düşünceleri, toplumsal ilişkileri, özel hayatları, hakkında bilgi toplanmakta; bu bilgilere göre “olumlu” bulunmayan kişilerin kamu görevine girme, seyahat, sosyal yardım, eğitim vb. pek çok hakkını kullanmalarının önüne geçilmektedir. Böylece ancak bir yargı organı tarafından adil bir yargılama sonucu ulaşılabilecek “mahkûmiyet” kararı, kişilere bilgi verilmeden, savunma hakkı tanınmadan, yürütme aygıtı içindeki kişiler tarafından, güvenlik soruşturması adı altında verilmektedir. Türkiye’de 15 Temmuz 2016 darbe girişiminden sonra olağanüstü hal döneminde güvenlik soruşturma uygulamasında önemli değişiklikler yapılmıştır. OHAL sonrasında bu uygulamalar ortadan kaldırılmamış, aksine Anayasa, ulusal ve uluslararası yargı kararları ile çatışma içindeki uygulama yeni düzenlemelerle derinleştirilmiştir. Bu kapsamda 2018 Aralık ayında kabul edilen bir yasa ile güvenlik soruşturması aracılığı ile hekimlik mesleği açısından “arındırma” yolu ile bir tür yeniden biçimlendirme politikası yürürlüğe konulmuştur.

  • Today, security clearance procedures are used to collect information about persons’ political convictions, social relations and private life, and when this investigation turns out as “negative” persons concerned are denied their rights to serve in public sector, travel, and to benefit from a range of opportunities and services including social assistance and education/training. This means the use of security clearance as a tool by those in the executive to impose upon persons some sanctions that can normally be decided only by the judiciary, and without even notifying or taking the defence of persons concerned. Following the coup attempt of 15 July 2016 in Turkey, important modifications were made in the practice of security clearance during the state of emergency regime (OHAL). When OHAL ended, these modifications were not lifted; to the contrary, the practice which is in contrast with the Constitution and both national and international court decisions has been further deepened. In this context, with a new bill adopted in December 2018, the dominant policy regarding the profession of medicine seeks to reshape the profession by “cleansing” in which security clearance is used as a means.
